Tyre and exhaust fitting services; all included in Class 37. The following voluntary geographical claim/limitation has been entered. The details are as follows: 1) The register proprietor acknowledges that Challenger Tyre and Auto Centre Limited owns the copyright in the trade mark. 2) Challenger Tyre and Auto Centre Limited shall have exclusive use of the trade mark in one part of the country and the registered proprietor shall have exclusive use of the trade mark in another part of the country. The areas in which the companies shall have use of the trade mark are to be determined as follows: 2.1 A circle will be drawn which has the Derby premises of Challenger Tyre and Auto Centre Limited at its centre and a second circle will be drawn which has the registered proprietor's Sheffield premises at its centre. The radius of each circle will be 30 miles. 2.2 A line will be drawn linking the points where the circumference of each of the circles touches. 2.3 Challenger Tyre and Auto Centre Limited shall have exclusive use of the trade mark in that part of the circle which is on the same side of the line as that company's premises in Derby and the registered proprietor shall have exclusive use of the trade mark in that part of the circle which is on the same side of the line as that company's Sheffield premises. 2.4 If the registered proprietor wishes to open new premises outside the areas contained in that part of the circle in which the company's Sheffield premises are situated, then the registered proprietor will apply to Challenger Tyre and Auto Centre Limited for permission to use the trade mark in such a manner and Challenger Tyre and Auto Centre Limited will not unreasonably withhold its consent.
